Charge laid in relation to fatal collision involving cyclist

Following a 2023 fatal collision between a motor vehicle and a bicycle that claimed the life of 78-year-old Patrick Lynch, Kingston Police have concluded their investigation, resulting in the motorist being charged.

On November 12, 2023, at approximately 3:30 p.m. emergency responders attended the area of Taylor Kidd Blvd one kilometer east of Coronation Blvd after receiving 911 calls of a collision involving a Subaru sedan and a bicycle, both of which were travelling east. On scene, lifesaving measures were provided to the cyclist, Patrick Lynch, who was transported to hospital via paramedics but was later declared deceased.

The driver of the Subaru, a 31-year-old local resident, stayed on scene and was cooperative with investigators. Kingston Police uniform patrol officers initially responded, with Traffic Safety Unit collision reconstructionists, forensic identification officers, and detectives also becoming involved. Taylor Kidd Blvd between Coronation Blvd and Collins Bay Rd was closed for approximately six hours while the collision scene was processed.

Upon reviewing all witness statements, physical evidence, collision reconstruction findings, and mechanically inspecting and examining both the vehicle and bicycle, Kingston Police formed grounds and subsequently charged the driver with Careless Driving Causing Death, an offence found within the Ontario Highway Traffic Act. Court-imposed penalties can include a maximum fine of $50,000, custodial jail sentence not exceeding two years, and/or up to a five-year driver’s licence suspension.

Kingston Police wish to remind motorists of their responsibility to share the road with cyclists, be cognizant of their presence, and pass in a safe manner when allowable. There is a legal obligation for motorists to leave at least one meter of space while passing a bicycle; the offence for disobeying this rule being a $110 fine and two demerit points upon conviction.
